LowOps

Terms of Service

LowOps, Inc., a Wyoming corporation  ·  Effective October 29, 2026  ·  Version 2026-10-29

AVIATION SAFETY NOTICE: LowOps is a supplemental situational-awareness tool only. It is not certified avionics, is not approved by the FAA or any other aviation authority, and must never be used as a primary means of navigation, obstacle avoidance, traffic separation or weather assessment. The pilot in command is solely responsible for the safety of every flight. Read Section 4 in full before use.
What changed on October 29, 2026. LowOps does not sell your personal information, and contributing flight data is now your choice (Section 6). We added terms for AI features (Section 5), Jobs and Marketplace (Section 8), operator accounts (Section 9) and paid plans (Section 10). We also changed how disputes are handled, including a right to opt out of arbitration (Section 19). The company is now named LowOps, Inc.

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you and LowOps, Inc., a Wyoming corporation ("LowOps," "we," "us," "our"). They govern your use of the LowOps mobile app, the flylowops.com website, the LowOps Fleet and Schedule web tools, and every related service (together, the "Service").

You accept these Terms when you tick the box or tap Agree while creating an account, or when we ask you to accept an updated version. If you use parts of the Service that need no account, such as the website, you accept these Terms by using them. If you do not agree, do not use the Service.

If you use the Service for an organization, such as a helicopter operator, flight school or employer, you confirm that you are authorized to accept these Terms for it. "You" then includes that organization.

The Privacy Policy and the Community Guidelines (in the app, under Settings › Community › Safety) form part of these Terms. A separate written agreement signed with us, such as an operator order form, prevails over these Terms where the two conflict.

2. The Service

LowOps helps helicopter and low-level pilots stay aware of their surroundings. It shows nearby obstacles (power lines, towers, cranes and other structures), gives proximity alerts, and displays airspace, charts, aviation weather, NOTAMs and ADS-B traffic. It also offers flight planning aids, a pilot logbook, flight recording, aircraft profiles and weight-and-balance tools, an AI assistant (the "Copilot"), aircraft document import, operator fleet and scheduling tools, a learning library, and community features: posts, photos, comments, direct messages, Jobs and Marketplace.

Some features are marked Beta or Soon, or are offered through TestFlight. They are previews: they may change, stop working or be withdrawn, and you should rely on them even less than on the rest of the Service.

The Service is expressly not:

3. Eligibility and your responsibilities

3.1 Age

You must be at least 13 years old to use the Service. If you are under 18, a parent or legal guardian must agree to these Terms for you and is responsible for your use of the Service.

3.2 Pilot in command

The pilot in command has sole, non-delegable responsibility for the safe conduct of every flight. Nothing in the Service relieves any pilot or operator of any legal or regulatory duty. You agree to:

3.3 Your account

Keep your sign-in details secure. You are responsible for activity under your account. Tell us at once at support@flylowops.com if you suspect someone else has used it. The information you give us, including your name, state or country of residence and any certificates or flight time you show to other users, must be true.

4. Aviation safety disclaimer

The Service is not certified, approved or endorsed by the FAA, EASA, Transport Canada, CASA or any other aviation authority, and it has not been tested or validated to any avionics standard.

4.1 Obstacle data

Obstacle data comes from government aviation authorities, electricity network operators, open-data publishers and other pilots. Every source is named, dated and credited on our Data Sources page. Obstacle data is a periodic snapshot, not a live feed. It is incomplete: wires, towers and other hazards may be missing, misplaced or out of date. The absence of an obstacle or an alert does not mean the area is clear. Always fly as if unmapped obstacles are present.

4.2 GPS, device and connectivity

The Service depends on your device's GPS, sensors, battery, software and data connection. Terrain, buildings, interference, jamming, solar activity, device faults and loss of connection can degrade or remove position accuracy and leave data missing or out of date. These limits are inherent in consumer devices and are outside our control.

4.3 Alerts

We do not guarantee that an alert will be given for any obstacle or hazard. Whether an alert is generated depends on data quality, position accuracy, device performance, your settings and other factors.

4.4 Weather, NOTAMs, airspace and charts

Weather, NOTAMs, airspace and chart data come from third-party and government sources and may be delayed, incomplete, filtered or out of date. NOTAM coverage, decoding and plain-language summaries in particular may omit or misstate a NOTAM. Do not use the Service as your official weather briefing or as your source of NOTAMs. Check current official charts and publications before flight.

4.5 Traffic

ADS-B traffic comes from third-party receiver networks over the internet. It is delayed, does not show every aircraft (many aircraft do not broadcast, and some are filtered at their owner's request), and can show aircraft in the wrong place. It is not a collision-avoidance system.

5. AI features: the Copilot and document import

The Copilot answers questions in plain language, and document import reads an aircraft document you choose and extracts figures from it, such as weights, arms and limitations. Both use artificial intelligence. AI output can be wrong, incomplete or out of date, even when it sounds confident.

6. Your data

6.1 We do not sell your personal information

LowOps does not sell your personal information. The Privacy Policy explains what we collect and why. If we ever want to use or share your personal information in a materially new way, we will tell you first and ask for your consent where the law requires it.

6.2 Contributing flight data

You can choose to contribute flight data: GPS tracks, altitude, speed and heading, alert and proximity events, helipad visits, and the conditions at the time ("Contributed Data"). Contribution is off until you turn it on, and you can turn it off at any time (Settings › Privacy & Data › Your data › Share my flight data). Every safety feature works either way; while contribution is off, your recordings and logbook stay on your device and are not backed up to our servers. When you contribute, you give LowOps a non-exclusive, worldwide, royalty-free licence to use Contributed Data to provide, secure and improve the Service. That includes building and correcting the obstacle database, improving alerts, and aviation-safety research. You also give LowOps a perpetual licence to create de-identified and aggregated data from Contributed Data, and to use that data for any lawful purpose. De-identified and aggregated data cannot reasonably be linked to you. You receive no payment for Contributed Data.

6.3 Hazard reports

When you report an obstacle or hazard, other pilots rely on it for their safety. You give LowOps a perpetual, irrevocable, worldwide, royalty-free licence to keep, verify, correct and show that report in the Service. If you delete your account, the report stays, without your name attached.

6.4 Your content

You keep ownership of everything you post, upload or send: posts, photos, comments, messages, logbook entries, listings, job applications and documents. You give LowOps a non-exclusive, worldwide, royalty-free licence to host, store, copy, process and display that content only to operate the Service and show it to the people you share it with. This licence ends when you delete the content or your account. The exceptions are copies kept for a limited time in backups, and copies we must keep for a pending moderation or legal matter.

7. Community rules

You are responsible for everything you submit. There is no tolerance for objectionable content or abusive behaviour. You agree not to submit, post or send content that:

7.1 Reporting, blocking and removal

Any post, comment, listing or message can be reported from within the app, and any user can be blocked. Blocking is mutual: neither of you will see the other's content, and a blocked user cannot message you. We aim to review reports within 24 hours. We may remove any content, and suspend or close any account, that breaks these rules, without notice and at our discretion. Repeated breaches, or a single serious one, lead to account closure.

7.2 Copyright complaints

If you believe content in the Service infringes your copyright, send a notice to hello@flylowops.com with the subject "Copyright notice". The notice must identify the work, the content you object to and where it appears, and give your contact details. It must also include a statement that you have a good-faith belief the use is not authorized, and a statement, under penalty of perjury, that the notice is accurate and that you are the owner or are authorized to act for the owner. Include your physical or electronic signature. We remove infringing content, and we close the accounts of repeat infringers.

8. Jobs and Marketplace

Jobs and Marketplace let employers, sellers, dealers and pilots find each other. LowOps provides the venue only. We are not an employer, recruiter, staffing agency, aircraft dealer or broker, escrow agent or party to any job, sale or other deal made through the Service.

9. Operator accounts

An operator, flight school or other organization ("Operator") can create a workspace in LowOps Fleet and Schedule and invite pilots and staff to join it.

10. Paid plans and billing

Some features may require payment. The price, billing period and what is included are shown before you buy, or in an order form or invoice.

11. Prohibited uses

You agree not to:

12. Intellectual property and data licences

The Service, its software, design and original content belong to LowOps and its licensors. Subject to these Terms, we give you a personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. Our names and logos may not be used without our written consent.

Data in the Service remains the property of its publishers and is used under their licences. These include the Open Database License (ODbL) for OpenStreetMap, Creative Commons licences, the French Licence Ouverte, the Open Government Licence – Canada, and public-domain U.S. Government works. Each dataset, its publisher, licence and date are listed on our Data Sources page. Crediting a publisher there does not mean it endorses LowOps.

If you send us feedback or suggestions, we may use them without any obligation to you.

13. Third-party services

The Service relies on third-party services, including Apple, our hosting and AI providers, and the data providers named on the Data Sources page. We do not control them and are not responsible for their content, availability or practices. Links to third-party websites are for convenience only.

14. Apple App Store terms

If you downloaded the app from Apple's App Store, these additional terms apply:

Questions, complaints or claims about the app should be sent to LowOps at the address in Section 23.

15. Disclaimer of warranties

The Service is provided "as is" and "as available." To the maximum extent permitted by law, LowOps disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that obstacle, airspace, NOTAM, weather, traffic or AI-generated information is accurate, complete or current, or that the Service will be uninterrupted, secure or error-free.

Some jurisdictions do not allow certain warranties to be excluded, so some of these exclusions may not apply to you.

16. Limitation of liability

To the maximum extent permitted by law, LowOps and its officers, directors, employees, agents, licensors and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to these Terms or the Service, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for all claims arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim arose, and (b) US $100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. That includes, where the law so provides, liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by our negligence. If a limitation in this Section is held unenforceable for a type of claim, the rest of this Section continues to apply to every other claim.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless LowOps and its officers, directors, employees, contractors, agents, licensors and service providers from third-party claims, and the resulting losses, liabilities and costs (including reasonable attorneys' fees), arising from: your breach of these Terms; your breach of any law or aviation regulation; any flight you conduct or direct; content you submit; or, for Operators, your use of data in your workspace.

18. Ending your use

You can stop using the Service and delete your account at any time in the app (Settings › Account › Delete account). We may suspend or close your account if you break these Terms or the law, if your use creates risk for other users or for us, or if we stop offering the Service. Where reasonable, we will give notice first. Sections 6.2 (the licence for de-identified data), 6.3, 12, 15, 16, 17, 19, 20, 21 and 24 survive termination.

19. Dispute resolution and arbitration

Please read this section carefully. It affects your legal rights.

19.1 Informal resolution first

Before starting arbitration or a court case, the party with the dispute must send a written notice describing it, and the relief sought, to the other party. Notices to LowOps go to hello@flylowops.com and the address in Section 23. Notices to you go to the email address on your account. Both parties will try in good faith to resolve the dispute for 60 days after the notice is received.

19.2 Binding arbitration

If the dispute is not resolved, it will be decided by binding individual arbitration administered by the American Arbitration Association ("AAA"). The AAA Consumer Arbitration Rules apply if you are an individual using the Service for personal purposes; otherwise the AAA Commercial Arbitration Rules apply. The arbitration will be held by video or telephone, or in person in the county where you live (or, for organizations, in Laramie County, Wyoming), unless the parties agree otherwise. Fees are paid as the AAA rules provide. The Federal Arbitration Act governs this Section.

19.3 Exceptions

Either party may bring an individual claim in small-claims court, or ask a court for an injunction to protect intellectual property or stop unauthorized access to the Service.

19.4 Mass claims

If 25 or more similar demands for arbitration are filed by or with the help of the same law firm or organization, the AAA Mass Arbitration Supplementary Rules apply. Those demands will be administered in batches as those rules provide.

19.5 Your right to opt out

You may opt out of this arbitration agreement by emailing hello@flylowops.com with the subject "Arbitration opt-out", within 30 days of first accepting these Terms or this version of them. Include your name and your account email. Opting out does not affect any other part of these Terms.

19.6 Public injunctive relief

If a claim for public injunctive relief cannot lawfully be decided in arbitration, that claim alone will be decided in court, after the arbitration of any other claims has finished.

20. Class action waiver

To the extent permitted by law, you and LowOps each may bring claims against the other only individually, and not as a plaintiff or class member in any class, collective or representative proceeding. If this Section is found unenforceable for a claim, that claim will be decided in court, not in arbitration.

21. Governing law and venue

These Terms are governed by the laws of the State of Wyoming and applicable U.S. federal law, without regard to conflict-of-law rules. Any matter that is not subject to arbitration will be decided in the state or federal courts in Laramie County, Wyoming, unless the law of the place where you live gives you the right to bring it in your local courts. This choice of law does not take away any protection you have under the mandatory consumer laws of the place where you live.

22. Changes to these Terms

We may update these Terms. For a material change, we will tell you in the app or by email at least 14 days before it takes effect, except where a change is required by law or addresses a safety or security issue. We will ask you to accept the updated Terms in the app. If you do not agree, you can stop using the Service and delete your account before the change takes effect. The version and effective date are shown at the top of this page.
